The Legislative Committee held a consultation meeting with the Alternative Dispute Resolution Centre (โADRCโ) on the Alternative Dispute Resolution (Amendment) Bill of Bhutan 2024 (Bill) for the second time at the Gakyid-Khangzang today. The discussion focused on aligning the countryโs legal framework with international standards such as the UNICITRAL Model and the 1958 New York Convention. Key topics included the distinction between domestic and international arbitration, with an emphasis on reducing judicial intervention in international cases and upholding party autonomy. The discussions highlighted the importance of arbitration being final and binding, ensuring that awards are enforced with minimal interference from domestic courts.
The meeting also discussed the introduction of emergency arbitration rules modeled after the Singapore International Arbitration Centre (SIAC), aiming to offer expedited dispute resolution while respecting the flexibility of party choice. The Chief Administrator of the ADRC emphasized the balance between judicial independence and the need for cost-effective arbitration, suggesting the creation of a more comprehensive register of qualified arbitrators for both domestic and international cases, stressing the importance of choice and flexibility.
The Committee will continue to review the Bill, with the intent to consider a few but substantive reforms, in alignment with best practices, the addition of fraud and corruption grounds for setting side awards, and refining procedural timeline for arbitration cases, noted are a few that the Committee believe will enhance the Arbitration credibility in Bhutan, and to becoming a preferred destination for international arbitration in Bhutan
