
National Assembly continues its deliberation on the Alternative Dispute Resolution (Amendment) Bill of Bhutan 2024
The National Assembly resumed the Third Reading of the Alternative Dispute Resolution (Amendment) Bill of Bhutan, 2024 today.
The House deliberated on the Bills from Section 48 till Section 140. With regard to Section 85, under Chapter V, pertaining to Jurisdiction of Arbitral Tribunal, which was amended by the National Council and accepted by the Legislative Committee to read as “The decision of the arbitral tribunal on a plea of jurisdiction may be appealed by any party within ten working days to the High Court. The decision of the High Court shall not be subject to appeal.”, the House acknowledged the intent and significance of the provision as submitted by the Committee. However, considering the concerns raised by some Members over the provision’s ambiguity, the House directed the Legislative Committee to consult legal experts and come up with a reformulation to provide more clarity.
